1. This privacy policy provides the principles and the scope personal data processing as well as the Clients’ rights and duties of the Personal Data Controller.

2. The data controller is ALL T&M spółka z ograniczoną odpowiedzialnością with its registered office in Wrocław at Legnicka Street 28/82, 53-673 Wrocław, entered in the register of entrepreneurs of the National Court Register maintained by the District Court for Wrocław – Fabryczna in Wrocław, 6th Commercial Division of the National Court Register under the number KRS: 0000443040, share capital of PLN 5,000.00, Taxpayer Identification Number (NIP): 8971786438.

3. The Controller shall process personal data of the Users for the purpose of proper execution of agreements concluded as part of the Internet Service www.allrestaurants.eu (hereinafter referred to as the „Internet Service”), i.e. for creating an account in the Internet Service, concluding the agreement, making settlements, rendering services for the Users, using all and any consumer rights by the Users (e.g. withdrawal from the agreement, warranty).

4. The Controller shall process the following personal data, provision of which is necessary to use the Controller’s services, i.e. first and last name/the company’s name, address, e-mail address, telephone number. Optionally, the Client shall provide Taxpayer Identification Number and data of the company if an invoice is required to be issued.

5. In the event of withdrawal from the agreement or if a complaint has been accepted when the refund is made directly to the User’s bank account, the User shall provide the bank account number for the purpose of the refund.

6. Personal data are processed in accordance with the provisions of the Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016.

7. Personal data of the Users shall be processed based on their consent expressed upon registration in the Internet Service.

8. Giving consent to personal data processing is totally voluntary, however, the lack of consent makes registration in the Internet Service and the use of the Controller’s services impossible.

9. Personal data shall be stored for the period necessary to carry out the User’s orders and investigate complaints, and shall be processed for the period corresponding to the period of holding the account in the Internet Service by the User, no longer than 3 years of liquidation of the account in the Service. If the User mandates services without creating the account in the Internet Service, then the data shall be processed for a period of 3 years of the date of the order. If personal data are processed for legally justified reasons and based on the User’s consent – the data shall be stored until the consent has been withdrawn.

10. The Users shall have the right:

a) to access their personal data and to receive copies thereof,

b) to rectify (correct) their personal data,

c) to delete their personal data,

d) to limit processing of their personal data – you may demand that we limit the processing of your personal data exclusively for the purpose of storing them or carrying out the agreed activities:

• if, in your opinion, your data that we possess are incorrect or we process them illegitimately, or

• if you don’t want us to delete them as you need them to establish, exercise or defend legal claims, or

• for the period of the objection you have raised against processing of your data,

e) to transfer personal data:

• you have the right to receive from us your personal data you have delivered in a in a structured, commonly used, machine-readable format (e.g. in .csv format),

• you can also mandate us to send such data directly to other entity.

f) to lodge a complaint to a supervisory authority – If you think that we process your data unlawfully, you can lodge a complaint to the President of Personal Data Protection Office or to other competent supervisory authority. In order to exercise your rights, you should provide the Personal Data Controller with the relevant demand. Please be advised that prior to the exercise of your rights, we will have to make sure that you have the aforementioned right, i.e. to identify you in a proper manner.

11. Personal data of the Users, apart from purposes indicated in this Privacy Policy, shall not be made available in any manner to third parties, including in particular other entities for the purpose of sending marketing materials of third parties.

12. Personal data of the Users of the Internet Service shall not be transferred outside the territory of the European Union.

13. The service uses „cookies," small files that help the device browsing the Internet (e.g. computer, smartphone etc.) to remember specific information concerning the device used. The information registered in cookie files are used, for instance, for advertising and statistic purposes and in order to adjust the Internet Service to individual needs of the Users. Cookie settings can be changed in one’s Internet browser. If the settings are not changed, cookie files shall be stored in the memory of the device. The change of cookie settings may limit functionality of the Internet Service.

14. The User can block saving of cookie files in the Internet browser. However, in such event the full use of functions of the website shall not be possible. Besides, the User can block the saving of data collected by cookie files related to the use of the website (including IP address) and send them to Google, and to provide such data by Google, downloading and installing a plug available under the following link: https://tools.google.com/dlpage/gaoptout?hl=pl.

15. AllRestaurants Website and application "location Function"

    
    

    a) AllRestaurants Website and application is first international archive for restaurants and food companies and the main aim of this project is to offer real, actual and correct information for users and most of this information is built on location feature to offer the best services.

    Requesting access to location, Requesting access to location in the background is important in AllRestaurants application because:

    ·         Guide user to correct addresses of restaurants, food companies and suppliers.

    ·         Gives users actual promotion and important information about restaurants around him when he move or make trip or visit new places.

    ·          Give him the ability to discover new places.

    ·         Help user to arrive there correct address.

    ·         Always provide user with the new update about restaurants and food companies around him.

    b) AllRestaurants project (Website and Application) and ALLTM L.L.C Company don’t use user’s personal information, location information, tracking information of users and don’t give any third part to use.

    c) AllRestaurants project (Website and Application) and ALLTM L.L.C Company don’t store user’s location or sale it for third part, and this information are stored in user side (Pc – Tablet – Smartphone or any other devices).
